Suggestions for Testifying

Be Informed. . .Review the proposal, the staff report, applicable provisions of the ordinance and comprehensive plan.  Learn the criteria used to consider the proposal’s merits, or other pertinent material.

Be on time. . . Although the item you are interested in may not be first on the agenda, you never know when it will be heard.  The governing body has authority to adjust the schedule according to its discretion.  Thus, anticipate attending from the beginning.

Speak to the point. . . The governing body appreciates pertinent, well organized, and concise comments.  Redundant testimony is prohibited and each individual is given three minutes to comment. Long stories, abstract complaints, or generalities may not be the best use of time.  Neighborhood groups are encouraged to organize testimony and have one person speak on behalf of the group. The “opposition representative,” like the applicant’s representative, receives ten minutes to make comments.  Applicant has five minutes to rebut or discuss issues raised by any opposition.

If you don’t wish to speak, write. . . At most hearings, previously submitted written testimony has been reviewed by the governing body before the meeting.  It is unreasonable to submit extensive written comments or information at the hearing and expect them to be reviewed prior to a decision.  All documents or written comments should be submitted to the Development Services Department at least one week prior to the meeting.

If you wish to testify, please arrive by 6:15 pm to sign-in. A sign-up sheet is located on a table near the entrance to the public meeting room. Please sign-in whether you testify or not. There are three columns on the sign-up sheet, so make sure you get into the preferred category for testimony.  Printed agendas are also located on this table. If you submit written testimony at the hearing, it will be accepted, but may not be considered by the governing body due to the lateness.  A determination will be made by the governing body at the time on whether to consider it or not. Witnesses will be given three minutes to testify.

The development consists of four (4) residential lots and is located in an “R-R” (Rural Residential) zone. The subject property is located on the north side of Lake Shore Dr. approximately 1130 ft. east of the intersection of Dearborn Rd. and Lake Shore Dr. in a portion of the NW ¼ of Section 17, T2N, R2W, BM, Canyon County, Idaho.

JO Properties, LLC is requesting a Comprehensive Plan Map Amendment to change the designation of parcel no. Kachupa Ridge Estates, PrePlat, IRR, Case # SD2018-0005
A request by Jay Walker for approval of a Preliminary Plat, Irrigation, & Drainage Plan for Kachupa Ridge Subdivision. The development consists of six (6) residential lots and is located in an “R-R” (Rural Residential) zone. The subject property is located on the north side of Purple Sage Road, at the northeast corner of the intersection of Kenridge Rd. and Purple Sage Road, in a portion of the SE ¼ of Section 26, T5N, R3W, BM, Canyon County, Idaho.

Obendorf Onion Processing, Conditional Use Permit, Case # CU2019-0005
Obendorf Farms is proposing to construct an onion processing facility on Fargo Road to include office space, basic production operations, packing and cold storage of onions.  Packing operations will operate weekdays 8 a.m. to 8 p.m. from August to April with truck traffic expected to be 6 trucks per day. Initially there will be 15 employees with an expected increase to 30 employees at full build out.  The applicant is proposing to utilize an existing domestic well for the facility.  Currently the site plan calls for a 150 foot x 300 foot processing facility and an agricultural storage facility 150 foot x 270 foot on the site.  The applicant is anticipating expansion including three additional storage buildings to be located west of the processing facility.  The subject property, parcel R36678, containing approximately 80 acres is located at 23295 Fargo Road, Parma, ID and is further described as a portion of the SE quarter of 04-4N-5W, BM, Canyon County, Idaho.

Mike Dudley, Rezone, Case # RZ2019-0005
Mike and Sherry Dudley are requesting to rezone six acres, parcel R33707010, from “RR” (Rural Residential) to “R1” (Single Family Residential) for the purpose of completing the proposed Noah’s Landing Subdivision development.  The road, power and pressurized irrigation systems are installed for a six residential lot development.  The subject property is located adjacent to 26530 Noah’s Landing Circle, Wilder and is further described as a portion of 03-3N-5W-NW, BM, Canyon County, Idaho.

Canyon County, Ordinance Amendment (Flood), Case # OR2019-0001
An Ordinance amending Chapter 7, Articles 2, 10, 14, 17, and 19, Zoning Regulations, of the Canyon County Code of Ordinances; and Severability Clauses; and Effective Dates.

  1. Chapter 7, Article 2, Section 3: Definitions Enumerated is amended replace the definition of “Accessory Building” to “Accessory Structure (Building)”, and the definition of “Recreational Vehicles (RV)” to meet state definition.
  2. Chapter 7, Article 10, Section 29 “F (Flood Hazard Overlay) Zone is repealed and replaced with the new overlay Section 07-10A to include revisions to statutory authorization, findings of fact, purpose and objectives, definitions, general provisions, administration, construction standards, variance and appeal procedures, penalties for violation and conflicting provisions of the floodplain overlay zone in accordance with the adoption of the 2016 Flood Insurance Rate Maps.
  3. Chapter 7, Article 10, Section 31 (Airport Overlay Zone) is repealed and replaced with the new overlay Section 07-10B.
  4. Chapter 7, Article 14, Section 17 (Mineral Extraction Short Term) and Chapter 7, Article 14, Section 19 (Mineral Extraction Long Term) is revised to include floodway development standards.
  5. Chapter 7, Article 17, Section 33(3) (Subdivision within a Floodplain) is repealed from Chapter 7, Article 17 and add a new overlay Section 07-10A-11(2)K (Floodplain Overlay Zone).
  6. Chapter 7, Article 19, Section 1 (Penalties) and Section 3 (Enforcement Procedures) is revised to add corrective procedures.

The Planning & Zoning Commission recommended approval of th zoning text amendments on April 4, 2019.  Their recommendations will be forwarded to the Board of County Commissioners who will consider approval of the ordinance amendments during a public hearing. All interested citizens are invited to attend this Public Meeting and present oral testimony concerning these matters.  All written testimony received prior to the hearing date will be provided to the commissioners.
